OFFICIAL RULES2) CONTEST TIMING: The Contest begins March 1, 2013, at or about 9:00am EST and ends March 31, 2013, at or about 11:59 PM EST. During the Contest there are a series of events that start and end on or about the dates/times noted in the calendar below ??. All times noted are Eastern Standard Time. Sponsor’s computer is the official time keeping device for this contest.
3) ELIGIBILITY: CONTEST OPEN ONLY TO LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES OR DISTRICT OF COLUMBIA (“D.C.”), 18 YEARS OF AGE OR OLDER AT THE TIME OF ENTRY. The officers, directors and employees of 1-800-PetMeds, its subsidiaries and affiliated companies, advertising, promotional and judging agencies, persons engaged in the development, production or distribution of materials for this Contest (collectively, the “Contest Parties”) and the immediate family members (parent, child, sibling, and spouse of each) of and/or persons living in the same household as such individuals (whether related or not) are not eligible to participate.
4) HOW TO ENTER: NO PURCHASE IS NECESSARY TO ENTER OR WIN, and no entry fee, payment or proof-of-purchase is necessary to participate in the Contest. You can enter the Contest through the PetMeds Facebook Page anytime during the Entry Period and follow the on-screen instructions: [1] Complete the registration form by providing the information required; [2] Upload a good quality photo of your pet along with a caption (“Entry”), photo must not exceed 2.0MB in size; [3] Click the enter now (or similar) button; [4] Share your entry via Twitter, Pinterest or Facebook (optional). As a part of the Contest entry process, the person submitting the entry (“Entrant”) will be required to indicate that they have read, accept and agree to be bound by these Official Rules. Limit one (1) entry per person per Entry Submission Period. Each pet may only be entered one (1) time even if there are multiple owners. If any individual submits entries in excess of the disclosed maximum, by any means, including but not limited to establishing multiple email addresses, they will be disqualified from participation in this Contest. The name of the person submitting the Contest entry must be the authorized account holder of such email address, otherwise, entry may be deemed void. In the event of a dispute over the identity of a potential winner, the entry will be declared made by the authorized account holder of the email address submitted at the time of entry, and potential winner may be required to provide identification sufficient to show that he/she is the authorized account holder. It is the sole responsibility of the entrant to notify 1-800-PetMeds in writing if the entrant changes his or her email address during the Contest Period.
Proof of submission of entry does not constitute proof of receipt of entry. All entries become the property of 1-800-PetMeds and will not be returned to the entrants. Each entry submission must be manually key stroked and manually entered by the individual entrant; automated and/or repetitive electronic submission of entries (including but not limited to entries made using any script, macro, bot or Contest service) will be disqualified and transmissions from these or related email or IP addresses may be blocked.
5) WINNER SELECTION: Public voting will begin at 9:00am EST on March 1, 2013, and will last until 11:59 PM EST on March 31, 2013 (“Voting Period”). At the start of the Public Voting Period set forth above, all qualified entry submissions will be posted for public voting on the PetMeds Facebook Page. Persons voting are encouraged to use the Judging Criteria to evaluate each submission. Entrants may vote for themselves. All online voting will be under the supervision of 1-800-PetMeds, whose decisions are final in all matters relating to this Contest. The use of any automated launching or entry software or any other mechanical or electronic means that permits contest website visitors to vote repeatedly is prohibited and all votes cast by such automated means will be disqualified. No person may vote by proxy for any other person. Neither you nor anyone acting on your behalf may offer consideration, services, or anything of value in an attempt to further your position in the Contest.
Judging Criteria:
After the Public Voting Period has ended, the Judging panel will score each eligible Entrant’s submission based on the above Judging Criteria. The entry with the highest score judged will be deemed the Grand Prize Winner, the remaining three highest scoring entries will be deemed the First Prize Winners. In the event of a tie for determining the Winners, all tied entries will be re-judged by an additional “tie-breaking” judge selected by Sponsor who will use the Judging Criteria above to break the tie. Sponsor decisions are final and binding in all matters relating to this Contest. Becoming a Prize Winner is subject to validation and verification of eligibility and compliance with all terms and conditions set forth in these Official Rules. All prizes will be awarded provided a sufficient number of qualified eligible entries are received. Non-winning and/or ineligible entrants will not be contacted. Sponsor reserves the right to terminate or extend the Entry Submission Period if a limited number of eligible entries are received.
6) WINNER NOTIFICATION AND PRIZE FULFILLMENT: Prizes are non-transferable, no substitutions allowed, except at the discretion of the Sponsor. Taxes, and all other expenses not specified herein, if any, are the responsibility of the winner. Prize winners will be notified by email on or about April 8th, 2013. Potential winners may be required to sign, notarize, and return an Affidavit of Eligibility/Release of Liability, a Publicity Release (where legal), and applicable tax information forms within 3 days of notification attempt, or an alternate potential winner will be selected, time permitting. Non-compliance with this time period and/or return of any prize/prize notification as undeliverable may result in disqualification and selection of an alternate winner. Any winner notification returned as undeliverable will result in prize forfeiture and an alternate winner may be selected at Sponsor discretion. If any required documents are not returned within the required number of days, or if any notification is returned as undeliverable, then prize may be forfeited and an alternate winner may be selected at Sponsor discretion. By participating in the Contest, entrants agree to release and hold harmless Sponsor, Administrator (who is this?), and each of their affiliates, licensees, parents, franchisees, subsidiaries, advertising and promotion agencies and their respective employees, officers, directors, shareholders, successors and assigns (collectively, the "Releasees") from any and all liability for any injuries, losses or damage of any kind which may arise in connection with this Contest or the acceptance and/or use of any prize. Any issues concerning the validity, interpretation or enforceability of these Official Rules, or the rights and obligations of entrants and Sponsor, shall be governed by and construed in accordance with the laws of the State of Florida, USA, without giving effect to any conflict of law rules which might find otherwise. 7) PRIZES: One (1) Grand Prize will be awarded: A one (1) year supply of Flea3X or Flea4X (will depend on pet type), a Max Donut Dog Bed, and One (1) $100 1-800-PetMeds gift certificate. Three (3) First Prizes will be awarded: One (1) $25 1-800-PetMeds gift certificate and a pet care package.
No more than the listed number of prizes will be awarded. All taxes and any other costs related to the prize not specifically stated within these Official Rules are the sole responsibility of the winner. Prizes will be awarded by U.S. mail and/or e-mail. No substitution, cash redemption, assignment, of prize permitted. However, Sponsor reserves the right to substitute a prize or portion of a prize with one of equal value if the prize is unavailable.
8) TERMS OF ENTRY/CONDUCT: By submitting an entry, you warrant and represent that the entry is your original work, that you can provide proof of ownership of the pet in the photo you submitted, that the entry has been legally created and has not been previously published or distributed in any media and has not been entered in or won previous contests or awards and that you have committed no fraud or deception in connection with such Entry, and that you have the sole and exclusive right to grant, transfer and assign all rights in and to such entry to the Contest Parties.
Entry may not contain a photo that was not created by Entrant and must not contain material that is unlawful, in violation of or contrary to the laws or regulations where Entry was taken. Further, you warrant and represent that you own all rights to your Entry, including without limitation, copyrights and that Sponsor’s publication of the Entry will not infringe on any third party rights. Each entry must not (1) include trademarks or copyrighted material not owned by entrant or used without permission (including, but not limited to, company names, brand names, etc); (2) use individuals’ names, in whole or in part without permission; (3) refer to public figures; (4) contain profanity, pornographic, or sexual content, content promoting alcohol, illegal drugs, tobacco, firearms, or weapons, hateful content of any kind (including racism, sexism, etc.), content that promotes violence or harm to another living creature, or any other offensive, obscene, or inappropriate content; (5) defame, misrepresent, or contain disparaging remarks about other people or companies, including, but not limited to Sponsor; (6) promote a political agenda regardless of the political affiliation; (7) contain materials embodying the names or other identifying elements of any person, living or dead, without permission; (8) mention, or refer to, any competing brands of the Contest Parties. Contest Parties assume no responsibility for any third party use of any Entry posted to the website; (9) be of a pet that is not legally owned by the person submitting the entry.
Entries that do not comply with these Official Rules, as determined in Sponsor sole discretion, will be disqualified from the Contest and may not appear on the contest website. Decisions of the Sponsor are final and binding. Entrant may be asked to provide proof of ownership of the pet in the submitted entry.
This Contest is subject to the laws of the United States only. By entering this Contest, entrants agree to be bound by these Official Rules and the decisions of Sponsor that shall be final and binding in all respects. Failure to comply with these Official Rules may result in disqualification.
9) LIMITATIONS OF LIABILITY: Contest Parties assume no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty, failed, garbled or jumbled electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Contest; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the operation of the Contest; (d) inaccessibility or unavailability of the Internet or any combination thereof, or; (e) any injury or damage to participant’s or to any other person's computer which may be related to or resulting from any attempt to participate in the Contest or download any materials in the Contest. If, for any reason, the Contest is not capable of running as planned for reasons which may include without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest in whole or in part. CAUTION: ANY ATTEMPT BY A USER OR ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND COSTS (INCLUDING WITHOUT LIMITATION, ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
10) WINNER RELEASES: By entering the Contest, you grant the Releasees permission to use your personal information in accordance with 1-800-PetMeds privacy policy, located at: http://www.1800petmeds.com/popup/privacy.htm. All entrants, as a condition of entry into the Contest, agree to release Sponsor, its subsidiaries and affiliated companies, suppliers, printers, application developers, advertisers, promotional or judging agencies, from and against any and all liability, loss, claims, demands or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with: (a) accessing the Contest page; (b) submitting an entry or otherwise participating in any aspect of the Promotion; (c) the receipt, ownership or use of any prize awarded; (d) preparing for, participating in or travelling to and/or from any prize-related activity; or (e) any typographical or other error in these Official Rules or the announcement of the offering of the prize. The winners shall bear all risk of loss or damage to the prize after it has been delivered. The Sponsor makes no representations or warranties of any kind concerning the appearance, safety, or performance of the prize. Winners grant to Sponsor the right to print, publish, broadcast and use worldwide in any media now known or hereinafter known (including without limitation use online at the website) the winner’s entry, name, address, voice, statement, picture or other likeness, without additional compensation, for public relations, advertising and promotional purposes as may be determined by Sponsor.
11) ADDITIONAL CONTEST TERMS: By entering this Contest, and to the extent allowed by law, entrants grant the Contest Parties and each of their affiliates, licensees, promotional partners, and third party marketing entities the absolute right and permission to edit, modify, cut, rearrange, add to, delete from, copy, reproduce, translate, dub, adapt, publish, exploit, and use the content of and elements embodied in the entries, in perpetuity in any and all media, including but not limited to digital and electronic media, computer, audio and audiovisual media (whether now existing or hereafter devised), in any language, throughout the world, and in any manner, for trade, advertising, promotional, commercial, or any other purposes without further review, notice, approval, consideration, or compensation.
